1. Introduction
By booking, confirming, instructing, accepting, or using any photography, videography, drone, floor plan, site plan, 360 tour, render, editing, or property marketing service provided by Robert Ince trading as iDeal Property Photography, you agree to these Terms and Conditions.
These Terms apply to all clients, including real estate agents, real estate agencies, property managers, vendors, landlords, tenants, builders, developers, business owners, marketing representatives, assistants, administrators, and any person or organisation requesting or authorising our services.
If you have any questions about these Terms, please contact us before confirming your booking.
2. Bookings and Authority to Book
Bookings may be made or confirmed by online booking form, email, SMS, phone call, text message, direct message, calendar invitation, or any other written or verbal communication accepted by iDeal Property Photography.
The person, agency, business, property manager, representative, organisation, or entity requesting or confirming the booking is deemed to be the client and is responsible for payment of all fees, unless otherwise agreed in writing by iDeal Property Photography before the shoot.
Where a booking is made by a real estate agent, property manager, agency representative, assistant, vendor representative, landlord representative, tenant representative, builder, developer, or other third party, that person and/or their business confirms that they have authority to book the services and accept these Terms and Conditions.
A booking is considered accepted once iDeal Property Photography confirms the appointment, attends the property, performs the work, or begins preparation for the project.
Any instruction to “invoice the office”, “invoice the agency”, “send it to accounts”, “bill the office”, or similar wording will be treated as confirmation that the relevant office, agency, business, or organisation is responsible for payment.
3. Agency, Property Manager and Third-Party Bookings
Where a real estate agency, property manager, sales agent, leasing agent, assistant, office administrator, builder, developer, marketing manager, or other representative books services with iDeal Property Photography, the booking party and/or their business is responsible for payment.
The booking party cannot later redirect payment responsibility to a vendor, landlord, tenant, purchaser, owner, bond account, rental ledger, marketing fund, settlement proceeds, insurance claim, or any other third party unless iDeal Property Photography has agreed to that arrangement in writing before the shoot.
If the booking party requests that an invoice be issued to a different person or entity, the original booking party remains responsible for payment unless iDeal Property Photography agrees in writing to release them from liability.
Payment is not conditional on the client receiving payment from a vendor, landlord, tenant, owner, purchaser, bond, rental income, settlement, marketing fund, insurance claim, or any other third party.
4. Payment Terms
Invoices are due within 14 days of issue unless otherwise agreed in writing by iDeal Property Photography.
For new clients, one-off clients, overdue accounts, high-value projects, regional projects, urgent bookings, or clients without an established payment history, iDeal Property Photography may require payment in full or part payment before the shoot, before editing, or before final media is released.
The client must pay the invoice by the due date regardless of whether the property is sold, leased, withdrawn, delayed, cancelled, occupied, vacant, relisted, transferred to another agency, or whether the client has received payment from any third party.
A monthly late fee of 4% may be applied to overdue invoices where permitted by law.
If payment is not received by the due date, iDeal Property Photography may suspend delivery, restrict download access, revoke or suspend any licence to use the media, remove gallery access, decline further bookings, and withhold further work until the account is paid in full.
The client agrees to pay reasonable debt recovery costs, filing fees, service fees, mediation fees, legal costs, and other expenses reasonably incurred in recovering overdue amounts, where permitted by law.
5. Cancellations, Access and Rescheduling
Cancellations made within 1 hour of the scheduled shoot time may incur a cancellation fee of $150 excluding GST.
If the property is unattended, inaccessible, unsafe, not ready, or cannot be photographed upon arrival, a cancellation fee of 50% of the total booking value may apply.
The client is responsible for ensuring access to the property at the agreed time. This includes arranging keys, codes, alarms, tenants, owners, pets, parking, building access, site access, security access, and any required permissions.
If a shoot cannot proceed due to access issues, property condition, safety issues, tenant/owner refusal, incorrect details, or circumstances within the client’s control, a call-out fee may be charged and rescheduling may incur full rates.
iDeal Property Photography reserves the right to postpone or reschedule shoots due to extreme weather, unsafe conditions, drone restrictions, access issues, illness, equipment failure, or other circumstances beyond our reasonable control.
6. Client Responsibilities
The client must ensure the property is clean, tidy, safe, accessible, and photo-ready before the scheduled shoot time.
Unless otherwise agreed in writing, iDeal Property Photography does not clean, stage, style, declutter, move furniture, move personal belongings, remove rubbish, move vehicles, move pets, or rearrange rooms.
The client is responsible for advising tenants, owners, staff, site managers, neighbours, building managers, or other relevant parties that the shoot is taking place.
The client is responsible for obtaining all required permissions for photography, videography, drone use, site access, building access, strata access, tenant access, commercial premises access, or use of the media in marketing.
The client must remove or secure any valuable, fragile, private, confidential, sensitive, personal, or identifying items before the shoot.
7. Property Presentation
The property will be photographed as presented at the time of the shoot.
iDeal Property Photography may make minor visual adjustments during editing, such as exposure, colour, contrast, sky enhancement, lens correction, vertical correction, minor blemish reduction, or general presentation improvements.
Unless specifically agreed in writing, editing does not include major retouching, structural alterations, virtual renovations, major object removal, furniture replacement, grass replacement, view replacement, renovation previews, or changes that could misrepresent the property.
The client is responsible for ensuring all marketing content complies with real estate advertising requirements and does not mislead buyers, tenants, vendors, landlords, or the public.
8. Content Delivery
Content is delivered by email, download link, online gallery, file transfer service, or another method selected by iDeal Property Photography.
Download links are valid for 30 days unless otherwise stated.
Original media is stored for 90 days after delivery. Retrieval after this period is not guaranteed and may incur a retrieval or re-delivery fee.
For new clients, overdue accounts, or clients without an established payment history, iDeal Property Photography may supply watermarked previews or low-resolution proofs until payment has been received in full.
Final unwatermarked media may be withheld until payment is received.
9. Edits, Revisions and Reshoots
One round of standard edits is included, unless otherwise stated in the quote or package.
Standard edits include reasonable adjustments to colour, exposure, contrast, brightness, alignment, cropping, minor blemish correction, and general image presentation.
Additional revisions, major retouching, item removal, virtual staging, sky replacement, grass replacement, image manipulation, video changes, floor plan changes, copy changes, or reshoots requested outside the original scope may incur additional charges.
Clients must request edits or revisions within 48 hours of delivery.
If no issue is raised in writing within 48 hours of delivery, the work will be deemed accepted.
10. Acceptance of Work
The client is deemed to have accepted the supplied media and completed services if any of the media is downloaded, published, uploaded, shared, supplied to a third party, used in a listing, used in marketing, used on social media, used on a website, used in print, or not disputed in writing within 48 hours of delivery.
Any dispute about the quality, scope, content, or delivery of the services must be raised in writing within 48 hours of delivery.
The client must not use disputed media unless the invoice has been paid or the dispute has been resolved in writing.
Use of the media does not waive iDeal Property Photography’s right to payment.
11. Copyright, Licence and Usage
All photographs, video footage, drone footage, floor plans, site plans, 360 tours, renders, graphics, edits, and other media created by iDeal Property Photography remain the copyright and intellectual property of Robert Ince trading as iDeal Property Photography, unless copyright is expressly assigned in writing.
Upon full payment of the relevant invoice, the client is granted a limited, non-exclusive, non-transferable licence to use the supplied media for the agreed property campaign or project only.
No licence to use the media is granted until the invoice has been paid in full, unless iDeal Property Photography agrees otherwise in writing.
The client must not use, publish, upload, distribute, edit, alter, sell, transfer, licence, share, or supply the media to any third party until payment has been received in full.
Use of the media before payment does not transfer copyright, does not waive the client’s obligation to pay, and does not create any ownership rights in the media.
Unless otherwise agreed in writing, the licence is limited to the original property campaign or project and may include use on the agency website, real estate portals, social media, print marketing, email marketing, brochures, signboards, vendor/landlord marketing, and other marketing directly connected to that campaign.
The media may not be reused for a later sale campaign, later lease campaign, Airbnb or short-term rental listing, builder promotion, commercial promotion, editorial use, portfolio use by another business, stock image use, third-party advertising, or any unrelated campaign without written permission and payment of any applicable re-licensing fee.
The client must not remove watermarks, metadata, copyright notices, branding, or attribution where supplied.
iDeal Property Photography may use created media for its own portfolio, website, social media, awards, advertising, proposals, case studies, and marketing unless a written confidentiality agreement or Non-Disclosure Agreement has been agreed before the shoot.
12. Floor Plans, Site Plans, Drone, 360 Tours and Renders
Floor plans, site plans, drone imagery, 360 tours, renders, and related marketing assets are supplied for marketing purposes only unless otherwise stated.
Floor plans and site plans are not architectural plans, survey plans, engineering documents, council documents, construction plans, legal documents, or compliance certificates.
Measurements, dimensions, boundaries, room names, furniture placement, land areas, and layout details should be checked by the client before publication.
iDeal Property Photography is not responsible for loss, error, or dispute arising from the client’s failure to check supplied plans or marketing material before use.
Drone services are subject to weather, safety, airspace, legal, privacy, access, and operational restrictions. iDeal Property Photography may refuse or modify drone work where conditions are unsuitable or unsafe.
13. Turnaround Times
Estimated turnaround times are provided as a guide only.
Standard photo delivery is generally within 24 hours where practical. Video, floor plans, site plans, 360 tours, renders, twilight edits, advanced edits, and larger projects may require longer.
Turnaround times may be affected by weather, access, project complexity, revision requests, subcontractor availability, public holidays, illness, power/internet outages, or other circumstances beyond our reasonable control.
iDeal Property Photography is not liable for loss arising from reasonable delivery delays.
14. Liability
To the maximum extent permitted by law, iDeal Property Photography is not liable for delays, cancellations, access issues, loss of sale, loss of rent, listing delays, campaign delays, third-party platform delays, website issues, portal issues, client errors, agent errors, vendor/landlord/tenant issues, or any indirect or consequential loss.
The client is responsible for checking all media, plans, copy, property details, measurements, addresses, names, branding, and campaign material before publication.
Our liability is limited to the amount paid for the specific service giving rise to the claim, except where liability cannot be excluded or limited under Australian law.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection that cannot be excluded under Australian law.
15. Safety
iDeal Property Photography reserves the right to cancel, postpone, or modify any shoot if the environment is unsafe, hazardous, unlawful, aggressive, threatening, inaccessible, or unsuitable.
This includes unsafe construction sites, unstable structures, dangerous animals, aggressive occupants, hazardous materials, severe weather, electrical hazards, height risks, traffic risks, unsafe drone conditions, or any situation that creates unreasonable risk.
Outdoor, twilight, drone, and aerial shoots may be postponed or cancelled due to adverse weather including rain, storms, lightning, high wind, heavy fog, poor visibility, unsafe airspace, or unsuitable light.
16. Force Majeure
iDeal Property Photography is not liable for failure or delay in providing services due to causes beyond our reasonable control, including illness, injury, family emergency, travel delays, vehicle issues, equipment failure, software failure, internet outage, power outage, natural disasters, extreme weather, government restrictions, legal restrictions, site closures, safety risks, or acts or omissions of third parties.
In such cases, rescheduling, alternative delivery, credit, or refund may be offered at our discretion depending on the circumstances and work already completed.
17. Subcontracting
iDeal Property Photography may engage trusted subcontractors, contractors, editors, drone operators, floor plan providers, virtual staging providers, 360 tour providers, or other service providers to fulfil part or all of the services.
All subcontractors are expected to work to professional standards and comply with confidentiality requirements where applicable.
The client agrees that subcontractors may be used unless otherwise agreed in writing before the booking.
18. Service Area and Travel Fees
Our standard service area is within 50 km of Tumbi Umbi, NSW.
Travel outside this radius may be charged at $20 per 10 km or part thereof, unless otherwise agreed in writing.
Regional, interstate, multi-site, commercial, construction, and large-scale projects are quoted individually.
Parking fees, tolls, accommodation, flights, hire vehicles, ferry costs, site induction fees, or other project-related expenses may be charged to the client where applicable.
19. Debt Recovery and Disputes
If an invoice remains unpaid after the due date, iDeal Property Photography may issue reminders, a final notice, or a letter of demand.
If payment is not received after a final notice, iDeal Property Photography may refer the matter to the NSW Small Business Commissioner, a debt collection service, or commence proceedings in the NSW Local Court or another appropriate tribunal or court.
The client agrees to pay reasonable filing fees, service fees, mediation fees, debt recovery charges, legal costs, and other reasonable costs incurred in recovering overdue amounts, where permitted by law.
The client agrees that any written confirmation, email, SMS, text message, booking form, calendar entry, invoice, proof of attendance, proof of delivery, proof of publication, or use of supplied media may be relied upon as evidence of the booking, delivery, acceptance, and debt.
20. Privacy and Confidentiality
The client is responsible for removing or concealing private, sensitive, confidential, or identifying material before the shoot.
iDeal Property Photography will take reasonable care with client information, addresses, access details, keys, codes, contact details, and project information.
Client information may be used for booking, invoicing, delivery, communication, marketing administration, legal compliance, debt recovery, and business record-keeping.
iDeal Property Photography may disclose relevant information to subcontractors, service providers, insurers, accountants, legal advisers, debt recovery providers, mediators, courts, tribunals, or authorities where reasonably required.
21. Confidential Projects and NDAs
If a project is confidential, sensitive, unreleased, private, or subject to restricted use, the client must notify iDeal Property Photography in writing before the shoot.
Any confidentiality requirement, embargo, restricted publication period, or non-disclosure agreement must be agreed in writing before the booking is confirmed.
Unless a written confidentiality agreement or NDA is in place, iDeal Property Photography may use completed media for its own portfolio and marketing purposes.
22. Changes to Scope
Any services requested outside the original booking, quote, package, or agreed scope may incur additional charges.
This may include additional rooms, extra images, additional video edits, extended shoot time, twilight photography, drone work, floor plans, site plans, 360 tours, virtual staging, renders, extra travel, urgent delivery, major retouching, revisions, or reshoots.
Where additional work is requested on site or after delivery, the client agrees to pay the additional charges quoted or reasonably charged for that work.
23. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia.
Any dispute relating to these Terms, services, invoices, copyright, licence, payment, or use of media will be resolved in New South Wales courts, tribunals, or dispute resolution bodies where applicable.
24. Updates to Terms
These Terms and Conditions may be updated periodically.
The version of the Terms in effect at the time of booking will apply to that booking, unless otherwise agreed in writing.
Continued use of iDeal Property Photography’s services after updated Terms are published or provided indicates acceptance of the updated Terms.
