1. Introduction

By booking our real estate photography, videography, or media services, you agree to these Terms and Conditions. If you have any questions, please contact us before confirming your booking.

2. Booking and Payment

Bookings

• All bookings must be made through our online booking form or confirmed via email.

• A confirmation will be sent once your booking is accepted and scheduled.

Payment Terms

• Invoices are due within 14 days unless otherwise agreed in writing.

• A 4% monthly late fee will be applied to overdue invoices.

• Media may be withheld if payment is not received.

3. Cancellations, Access & Rescheduling

• Cancellations made within 1 hour of the scheduled time incur a $150 (ex. GST) cancellation fee.

• If the property is unattended or inaccessible upon arrival, a cancellation fee of 50% of the total booking value will apply.

• We reserve the right to postpone or reschedule shoots due to extreme weather or unsafe conditions.

4. Client Responsibilities

• The client must ensure access to the property at the agreed time.

• Properties should be clean, tidy, and photo-ready.

• We do not move, stage, or clean furniture or belongings.

• If the shoot cannot proceed due to the property condition, a call-out fee will be charged, and rescheduling will incur full rates.

5. Content Delivery

• Content is delivered via email or download link.

• Download links are valid for 30 days.

• Original media is stored for 90 days post-delivery. Retrieval after this period is not guaranteed and may incur a fee.

6. Edits & Revisions

• One round of standard edits is included.

• Additional revisions or reshoots requested outside the scope of the original booking may incur additional charges.

• Clients must request edits within 48 hours of delivery.

7. Copyright & Licensing

• All media remains the copyright of Ideal Property Photography (Robert Ince).

• Clients are granted a limited, non-transferable license to use content for one property campaign only.

• Content may not be reused, altered, sold, or shared with third parties without written consent.

• We reserve the right to use any created content for marketing and portfolio purposes unless a signed Non-Disclosure Agreement (NDA) is in place.

8. Liability

• We are not liable for delays, damages, or cancellations caused by third parties, weather, or access issues.

• Clients should remove or secure any valuable or fragile items before the shoot.

• Our liability is limited to the amount paid for the specific service.

9. Force Majeure

We are not liable for failure to provide services due to causes beyond our control, including illness, travel delays, equipment failure, natural disasters, or legal restrictions. In such cases, refunds or rescheduling may be offered at our discretion.

10. Safety

• We reserve the right to cancel or postpone any shoot if the environment is unsafe, hazardous, or unlawful.

• Outdoor shoots will not proceed during adverse weather conditions (e.g., rain, lightning, fog).

11. Subcontracting

We may engage trusted subcontractors to fulfill our services. All subcontractors adhere to our standards and confidentiality requirements.

12. Service Area and Travel Fees

• Our standard service area is within 50 km of Tumbi Umbi, NSW.

• Travel outside this radius is charged at $20 per 10 km.

• Regional or interstate projects are quoted individually.

13. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Disputes will be resolved in NSW courts.

14. Updates

These Terms may be updated periodically. Continued use of our services implies acceptance of any changes. Please refer to this page for the latest version.
